Virtual Counseling Privacy Policy

Virtual Counseling Privacy Policy Purpose
This policy explains how privacy and confidentiality are protected during virtual (telehealth) counseling sessions. Virtual counseling includes services provided by video, phone, or other secure electronic platforms.

Confidentiality
All information shared during virtual counseling sessions is confidential and protected to the same extent as in-person counseling. Information will not be disclosed without written authorization from the client, except as required by law.

Limits of Confidentiality
Confidentiality may be broken without consent in the following situations:

  • Risk of harm to self or others
  • Suspected abuse or neglect of a child, elder, or dependent adult
  • Court orders or other legal requirements

Clients will be informed whenever possible if disclosure is required.

Technology and Security
Reasonable efforts are made to use secure, HIPAA-compliant platforms for virtual counseling. Despite these safeguards, electronic communication carries some risk. Clients acknowledge that confidentiality cannot be guaranteed due to potential technology failures, hacking, or unauthorized access.

Client Responsibilities
Clients are responsible for:

  • Participating in sessions from a private, quiet location
  • Using a secure internet connection when possible
  • Protecting personal devices with passwords or security features
  • Informing the counselor if privacy is compromised during a session

Session Environment
Sessions should take place in a setting where conversations cannot be overheard. Use of headphones is encouraged to enhance privacy.

Recording
Virtual counseling sessions will not be recorded by the counselor or the client without prior written consent from both parties.

Emergency Situations
Virtual counseling is not appropriate for emergencies. Clients are encouraged to call 911, go to the nearest emergency room, or contact a local crisis line if immediate help is needed. Clients agree to provide current contact information and location at the start of services.

Consent to Virtual Counseling
By participating in virtual counseling services, clients acknowledge they understand the risks and benefits of telehealth and agree to the terms outlined in this privacy policy.

Policy Updates
This policy may be updated as technology or legal requirements change. Clients will be notified of any material changes.
